Marc N. Bernstein Marc Bernstein has been a commercial and intellectual-property litigator for over twenty years. His work has encompassed a wide spectrum of high-technology and commercial issues, including patent, trademark, and copyright infringement; unfair competition; trade secret misappropriation; breach of contract; and domain name and Internet-related disputes. Awarded the highest attorney rating - AV - by Martindale-Hubbell and selected for inclusion in Super Lawyers in both 2008 and 2009, Mr. Bernstein has represented major technology companies including Alcatel-Lucent, Lycos, F-Secure, Fortinet, and CEVA, and international concerns in Australia, Japan, Israel, Ireland, Finland, Denmark, Spain, India, and Mexico. In 2004 and again in 2009, Mr. Bernstein was appointed by the U.S. District Court for the Northern District of California as a Special Master in patent and other litigation. In 2003, Mr. Bernstein was a featured speaker at an International Bar Association panel entitled "Biocyberethics: What To Do When A Computer Wants To Be Your Healthcare Client." Alice Garber is an engineer and senior patent litigator with extensive experience in a wide variety of patent disputes for clients such as Cisco, Infineon Technologies, Micron, RealNetworks, CNET, Time Warner, and Comcast. As a partner at Kirkland & Ellis, Ms. Garber was lead inequitable-conduct counsel on a trial team that achieved a defense verdict against an $800 million patent infringement claim. Ms. Garber has played substantial roles in state and federal courts throughout the United States, including the patent "hot docket" jurisdictions in the Eastern District of Texas, the District of Delaware, the Northern District of California, and the Eastern District of New York, as well as before the International Trade Commission. Ms. Garber has taken over eighty depositions in the U.S. and overseas, has managed all aspects of complex commercial litigation and its staffing, and has significant experience in assessing cost-effective strategies for patent and other complex litigation. She has technological experience with hardware and circuitry, semiconductor fabrication, software, and the Internet. Formerly a commercial and patent litigator for over twelve years with Latham & Watkins and Morrison & Foerster, Will Fitton is a graduate of Yale Law School, where he was Editor-in-Chief of the Yale Journal on Regulation. Mr. Fitton's extensive patent litigation experience includes representation of Yahoo!, Nikon, Novartis, Aspect Software, and Genentech in various U.S. courts. In developing and directing litigation strategy in complex intellectual property and commercial cases, Mr. Fitton has worked closely with the in-house counsel and corporate executives of major companies, with an eye toward obtaining, protecting and monetizing intellectual property. This includes working with clients on budgeting and expense-management issues, as well as in directing and managing complex multi-national and multi-language paper and electronic discovery. Anthony J. Patek is an intellectual property litigator with a special focus on biotechnology and pharmaceutical matters and enforcement of technology patent portfolios. Before joining The Bernstein Law Group, Mr. Patek served as a Law Clerk for the Honorable Edward C. Reed of the U.S. District Court in Reno, Nevada and worked at Cooley Godward Kronish. Mr. Patek holds a Master's degree in chemistry from Stanford University, as well as three undergraduate degrees from the University of Michigan, in chemistry (with honors), molecular biology, and philosophy (cum laude). Susan Boranian has handled all aspects of complex commercial litigation at both the trial and appellate level. A litigation attorney for ten years at Morrison & Foerster before coming to BLG, Ms. Boranian has appeared as counsel of record in state and federal courts throughout California, including oral argument in the Ninth Circuit U.S. Court of Appeals. After graduating magna cum laude from Harvard University, Ms. Boranian received her law degree cum laude from Northwestern University School of Law, where she served as Managing Editor of the Northwestern University Law Review. Jason A. Pikler is a commercial litigator with experience in patent and class-action cases, among others. Before joining BLG, Mr. Pikler worked at Morrison & Foerster, receiving the Wiley W. Manuel Award for Pro Bono Legal Services from the State Bar of California. Mr. Pikler graduated with high honors from the University of Texas School of Law, where he served as associate editor of the Texas Law Review, received multiple Dean's Achievement Awards, and was a member of the Chancellor's Honorary Society and the Order of the Coif. Mr. Pikler interned with the Honorable David Puryear of the Texas Third Court of Appeals. He holds a master's degree in literature and language from the University of Virginia, as well as a bachelor of arts degree (with honors) in English from Haverford College.
